Fees

Mr. Stenberg can be most helpful and effective when he knows the client's business operations and understands the client's issues with one or more State Attorneys General in the context of other litigation in which the client is involved. For that reason, he recommends a long-term relationship involving a monthly retainer.

Monthly Retainer
A monthly retainer has several advantages from the client's standpoint. One is that the legal fees are fixed and known in advance. The second is that it provides an incentive to resolve issues expeditiously. An hourly rate creates incentives to prolong the amount of time required for the legal resolution. Third, it encourages communication because there is no additional charge for each telephone call or meeting (other than reasonable travel costs and other out-of-pocket expenses). Mr. Stenberg's retainer fee includes settlement discussions but not other aspects of litigation.

Fixed Fee
In some circumstances, a flat fee to advise on, and help negotiate the resolution of, a specific issue with a specific Attorney General or state agency may be appropriate and desirable.

Hourly Rate
Where a project will clearly require a large and undeterminable amount of time, work at an hourly rate can be agreed upon.
