Don Stenberg has extensive experience in the Nebraska initiative and referendum process. As Attorney General he successfully challenged a state statute that made it a criminal offense for a petition circulator to cross county lines, State ex rel. Stenberg v. Beermann, 240 Neb. 754 (1992), and a state statute that required an exact match between voter information on a petition and the voter registration records. State ex rel. Stenberg v. Moore, 258 Neb. 199 (1999).

In 2008, he represented Ward Connerly's American Civil Rights Coalition in a successful initiative petition effort. In 2006, he represented small school advocates who placed a referendum measure on the ballot which won voter approval.

In the 1970s and 1980s he represented several initiative and referendum efforts that were successful in placing issues on the Nebraska ballot.

Don Stenberg also authored a chapter in M. Dane Waters' book, "The Battle Over Citizen Lawmaking, An In-Depth Review of the Growing Trend to Regulate People's Tool of Self-Government: The Initiative and Referendum Process."
